When will we ever stop seeing and feeling the effects of what he did to this country? The DOJ, his cleansing the armed services of patriotic warriors, the Russian collusion hoax, his minions going after political opponents long after he left office, and this, his appointed judges creating constant judicial tyranny. Will America ever be able to move past Obama’s authoritarian Tyranny?
Judicial tyranny. Where does it end? Seems to me rogue judges, who think they are little gods, feel they can rule on anything. And they can allow violent criminals to be released back into society - to kill again. Not too long ago this happened within an hour of being released. I have to ask - where is accountibility for these very bad decisions?
It seems there is none. Once you rise through the ranks and get to a certain status the law no longer applies to you. Blind justice has become a myth. “In the halls of justice, the only justice is in the halls" cynical comedian Lenny Bruce.
But you well know the pendulum swings from one extreme to another. At this moment it seems that crime is not only being excused, it's being justified. So, as it worsens, those who think they are gods will get to personally experience the wrath of the real God.
Taken to absurdity, an "offended party" could challenge the appointment of any one, by any one, to any thing. An "offended party" could challenge a president's right to appoint a man or a woman as his "advisor". Solution: All federal judges have a tenure of 8 years. No more. Makes federal judges toothless tigers.
Unfortunately James, this goes so much further than just one administration. The core of this tyranny goes straight to the "Heart" of the matter. Only when a majority of lawmakers of any persuasion decide that ethics are more important than power, and that ethics are what make the powerful effective, there won't be a significant change on either side of the fence.

The procedural legal aspects of the case clearly are critical to how the case will be adjudicated. However, the underlying issue may never be discussed - that big Pharma is using its proxy, AAP, to try to control the vaccine market to protect its interests. It is an issue of corporate capture of an executive agency thwarted by an HHS secretary who objects to this incursion, and the corporate response to this to try to maintain its stranglehold on the industry. It might be subtitled, "When crony capitalism was challenged, how the crony capitalists fought back."
From a lay person's point of view, it all looks really simple: each judge does what his own politics dictates at the time. All this stuff about law, separation of powers and precedent is just dressing to be added to justify whatever the judge wants at the time. (Too cynical, I know, but it sure looks that way from out here in the cheap seats.)
As a former FACA member of the USDA National Organic Standards Board (NOSB), this is situation with the ACIP is truly intriguing and I do hope the 3 judge panel rules in favor of the new ACIP as the current HHS has it constituted. Despite whatever caused the delay in the DOJ to take up the case in favor of the ACIP as it has been c related by Sec. Kennedy, to my knowledge duly appointed members of a FACA are under the purvue of the Secretary who appoints them. What the charge of the FACA is as you write, is quite different. Perhaps unique, but the 15 seats on the NOSB are actually defined in the Organic Foods Production Act of 1990 as to how many seats are for producers, environmental scientists, certifiers, etc. And the NOSB is further unique in that the Secretary of Agriculture cannot add nor delete materials on the list of allowable or prohibited materials for use in organics. That is all statutory. I would hope that the 3 judge panel looks to the statutory definition of the FACA instead of via the Administrative Procedures Act (which has ballooned the bureaucracy and given unimaginable power in many cases beyond statutory intent). If you were duly appointed, and as precedent shows changes in Administration make up of FACA’s previously, then the ACIP as the current Secretary constituted it should stand and any advice the FACA has given (which, as you’ve said, is up to the parent agency to accept or decline).
I’m surprised that purist, activist groups within the organic sector haven’t made a play on this. But indeed they have at times, pointing out seats being occupied by corporate organic folks rather than grass roots organic folks. But that can only be pointed out, not reversed. The only thing that recently has played in is that the current USDA Secretary did not fill some seats on the NOSB in time for their last meeting, thus bringing up the point that the meeting and its decisions have no standing. I’m not sure what the status of that is currently. But that is a different principle than challenging actual appointees.
Please keep us updated. You’re right, this is way beyond any specific topic (like vaccines or in the case of NOSB and hydroponics). It gets to the core of volunteer citizen involvement in our democratic governmental process. Whether an activist group (AAP in the ACIP case) can actually challenge duly voted-on advice by a FACA is beyond their reach, even though they wish it wasn’t and will use whatever it takes to steal the voice of the citizenry.
It is so depressing seeing the judiciary blocking everything the executive branch does. This is not functioning democracy and obvious to everyone. We the people must insist this stop. It is hurting we the people and our children.

I think I know who a couple of those skeptics could be. This is only one piece of a juicy bit of tyranny being questioned. I can only hope that the day will produce a decision to uphold the deeper knowing that stands in each judge's Heart.
Bottom line: AAP is the marketing arm of the vaccine manufacturers. To continue to grow the use of vaccines as the #1 weapon against infectious disease, ACIP must be an extension of AAP's role.
To have a balanced ACIP in essence negates the growth of vaccines and RNA injections where billions and billions have been invested and there must be a ROI. Using the judicial system to maintain control is the objective. I suspect Dr. Malone sensed this when he was involved.

"We cannot allow the breakdown of the federal process to create a vacuum in evidence-based vaccine guidance." Certainly standing is of relevant concern. The "harm" in the end being a reduced income from vaccines, if attending physicians are required to inform patients on the particulars relevant to each vacination, so the patients can effectively give their 'informed consent'. The physician has to devote unreimbused time to discussion and the patients may well in the end decline vaccination. If association members incomes are reduced, Association dues/ reimbursements could be impacted. Further these Associations might suffer reduced grants from impacted vaccine producers.
The other relevant concern to me, is the impact this ruling has on the wellbeing of our population. With meaningful federal analysis and actions on the potentially harmful modified mRNA platform and payloads (and particularly as relates to CDC schedule recommendations) being suspended or curtailed. I'm reading one of the physicians (who received the Nobel award for it) is saying the modified mRNA platform needs further work before (appproval) general use.
One surely hopes this review will curtail rogue judges, who would impose unwarranted, poorly supported rulings that negatively affect us all.
Will be watching for further actions on this matter. No doubt that should the AAP, etc garner an unfavorable outcome, it will be appealed.

From listening to discussions by qualified medical sources, forgoing the mRNA flu shot is likely the best outcome out here.
